Course Overview

NDR was one of the first CoP specialist mediation panels and this course is based on our experience of CoP mediation including our provision of the Office of the Public Guardian’s Mediation Pilot

This course is designed for both those who are new to working under the Mental Capacity Act and those familiar but wish to learn how to apply it to mediation sessions. 

The course has two modules; the first is theoretical and teaches the Mental Capacity Act to those who have yet to study it as part of their professional practice. You are exempt from this module if you have demonstratable experience of the MCA 2005 including working in law, healthcare, social work and medicine. 

The second module takes place over a single day by zoom or similar.

This module aims to build the practical skills required to run Court of Protection mediations including the advanced party management skill unique to this area. 

In addition to the practical mediation skills, it looks to the unique requirements of conducting mediations about a 3rd party who is not present in the mediation itself. This includes arrangements to promote best interests, integrating with the court process and challenges to practice. 

We will also cover advanced issued including fluctuating capacity and disputes where P attends mediation, and where the conflict is directly between P and P’s court appointed deputy/attorney.

This course is directly taught by Alex J McCulloch, the lead mediator on the OPG pilot, panel member on the Court of Protection Mediation Pilot. Alex J McCulloch has undertaken hundreds of CoP mediations including some under very unique circumstances.
